
Thorpe genocide appeal case back in court
Krauatatungalung Elder Uncle Robbie Thorpe is appearing before the Victorian Supreme Court of Appeal seeking to advance historic legal proceedings to charge King Charles III with the genocide of Aboriginal people.
The appeal relates to attempts by Mr Thorpe to initiate genocide-related proceedings concerning the treatment of Aboriginal people under colonial and Crown authority.
The case raises questions concerning:
● ongoing acts of genocide against Aboriginal people
● the application of international genocide law in “Australia”
● whether Crown representatives can be subject to prosecution
● the inability and unwillingness of Australian courts to properly address genocide
● sovereignty and unceded Aboriginal land that challenges coloniser jurisdiction
Mr Thorpe said the proceedings form part of a decades-long campaign seeking justice and international accountability.
“Genocide is a crime, not just globally, but right here in our backyard. If we are serious about stopping genocide around the world, we must start by eradicating it here in so-called Australia,” he said.
Mr Thorpe has been involved in genocide litigation and sovereignty campaigns for decades, including legal actions seeking recognition of genocide under international law and challenging colonial legal structures in Australia.
